PetSpeak lets you create personalized animated pet videos by combining photos and audio recordings.
PetSpeak (“PetSpeak,” “we,” “us,” or “our”) is a mobile application (the “App”) that allows users (“users” or “you”) to create personalized animated pet videos. With PetSpeak, you can upload pet photos, record audio, and combine them into unique and entertaining animations (“Content”). Users can also access premium features through optional membership accounts (“Premium Accounts”).
The Services provided through the App (individually and collectively, the “Services”) are designed to enhance your creative experience. These Terms of Use (“Terms”) govern your use of the App and the Services.
By using PetSpeak (the "App"), you agree to these Terms of Service ("Terms"). If you do not agree, you may not use the App or its features.
PetSpeak allows personal and commercial use but prohibits illegal, harmful, or disruptive activities.
Permitted Use:
PetSpeak allows both personal and commercial use of the animated pet videos you create. You are solely responsible for ensuring your use complies with applicable laws and third-party rights.
Prohibited Use:
You agree not to misuse the App, including but not limited to:
Uploading illegal, harmful, or offensive content.
Attempting to disrupt the App’s operation or compromise its security.
Violating applicable laws or regulations in connection with your use of the App.
PetSpeak subscriptions offer unlimited video creation and faster processing, billed monthly or annually through your Apple ID.
Subscription Plans:
PetSpeak offers monthly and annual subscription plans, which provide users with unlimited video creation and faster processing times for video generation among other benefits.
Billing and Renewals:
Subscriptions are billed through your Apple ID.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the billing period.
Refunds:
All refund requests are handled through Apple’s App Store policies. PetSpeak does not manage refunds directly.
You own your creations, and PetSpeak only uses them to provide its services, while the App’s features and designs are protected.
Your Content:
You retain ownership of all photos, audio recordings, and videos you create using PetSpeak (“Content”).
By using the App, you grant PetSpeak a non-exclusive, royalty-free license to process your Content solely for the purpose of providing the Services.
PetSpeak’s Content:
All elements of the App, including its design, functionality, and features, are owned by PetSpeak and are protected by copyright laws. You may not copy, distribute, or modify these elements without permission.
By using PetSpeak, you release us from liability and agree to cover any claims or costs arising from your misuse or breach of these Terms.
By using PetSpeak, you agree to release and forever discharge PetSpeak, its partners, employees, agents, and affiliates from any claims, damages, or liabilities arising from your use of the App or its services.
Additionally, you agree to indemnify and hold harmless PetSpeak and its affiliates from any claims, losses, damages, costs, or legal fees resulting from:
Your breach of these Terms,
Content you create, upload, or use within the App,
Your use of PetSpeak or its services,
Misuse of the App by you or anyone using your account, or
Violations of any third-party rights.
PetSpeak reserves the right to take control of the defense and resolution of any matter subject to indemnification at its own expense.
If things go really wrong this is what will happen, along with some other general legal language.
These Terms are governed by and construed in accordance with the laws of England and Wales, excluding any conflicts of law principles. The United Nations Convention on the International Sale of Goods does not apply and is expressly excluded. Any disputes arising under these Terms will be resolved through binding arbitration under the rules of the International Chamber of Commerce, conducted in English, in London, United Kingdom. The arbitrator’s decision will be final and binding, and the prevailing party may recover reasonable legal costs. Arbitration must be commenced within two years of the event giving rise to the dispute.
Both parties agree to keep all confidential information private and use it only to fulfill obligations under these Terms. Confidential information includes, but is not limited to, marketing strategies, financial data, proprietary technology, and trade secrets.
These Terms are binding on successors and permitted assigns. PetSpeak may assign its rights and obligations, including through mergers or sales, while your obligations under these Terms are personal and require prior written consent for assignment, except for payment rights.
These Terms do not create an employer-employee, principal-agent, partnership, or joint venture relationship. You are responsible for obtaining licenses, maintaining insurance, and paying all applicable taxes related to your use of PetSpeak. Notices will primarily be sent via email, and you are responsible for keeping your contact details up to date.
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be in full force and effect.
These Terms constitute the entire agreement between you and PetSpeak, superseding all prior agreements or communications. No waiver or amendment will be valid unless explicitly provided in writing by PetSpeak.
